Agreement forms the easy way

Extra work and deviations from the original contract are part of everyday life in the construction industry.   

A builder pushes back a deadline. Something unexpected pops up on site. An extra task that needed to be done quickly grows along the way. And suddenly, both the schedule and the budget are going their own ways. This is where the agreement form comes into play.   

Agreement letters ensure that all parties agree on what the changes mean for both finances and the schedule, so that there is no room for doubt or conflict.

What is a contract form?

An agreement note is a written formalization of the changes made to the original contract. Agreement notes provide clarity about the agreed work and ensure that the contractor and client agree on the changes.  

At the same time, the agreement form is your guarantee of payment after completion of the work. Without a signed agreement form, you risk being left without proof and losing your claim. With it in hand, you are therefore in a strong position when it comes to settling the project finances.  

Although agreement notes are not legally binding, they are considered best practice in the industry. They prevent misunderstandings and provide peace of mind in construction projects, where changes are the rule rather than the exception. 

As lawyer Patrick Rask Buskbjerg from Molt Wengel points out, it can be an expensive affair if the agreements are not in place: 

"It can quickly become an expensive affair if the agreement documents are not legally sound. With a few simple adjustments, you can usually quickly ensure that the agreement is watertight in the event of a dispute," Patrick Rask Buskbjerg, lawyer, Molt Wengel.

What should a contract note contain?

An agreement form must be clear, transparent, and easy to understand. It should contain at least the following: 

  • A precise description of the change 
  • A description of the impact of the change on costs and schedule 
  • The reason for the change and why it is necessary 
  • Any revised drawings, specifications, or other attachments 
  • Division of responsibilities – who implements the change and how is quality assured? 
  • Signatures from all parties to formalize the agreement
